What is an Architect Contract?

An Architect Contract is a legal agreement that describes the duties and rights of the parties engaged in a construction project. A precise contract between a company or developer and an architect is essential.

An Architect Contract ensures that all parties are on the same page about what is expected, who will do what, how long the project will take, how much it will cost, and when it will be done. What are the scopes of work of the architect?

The Architect is needed to deliver the following services:

➤ Sanitary, plumbing, drainage, water supply and sewerage design.

What are the steps to pay an architect?

On the day of the appointment/signing of the agreement/acceptance of the offer. Rs. 20M* or 5% of total fees charged, whichever is greater, changeable at the final stage.

Step 1. Conceptual drawings and cost

Submit conceptual drawings and an approximate cost estimate. 10% of the total costs payable.

Step 2. Preliminary scheme for client approval

Submitting the needed preliminary scheme for Client approval, along with a preliminary cost estimate. 20% of the total costs payable, less any payments received at Stage 1.

Step 3. Client/statutory authority approval

➤ Incorporating Client ideas and submitting designs for Client/statutory authority approval, if necessary
➤ Upon receipt of the Client's / legislative authorisation required for construction to begin, wherever applicable

30% of the total costs payable, less payments made at Steps 1 and 2.
35% of total fees due less payments collected at Steps 1 to 3.

Step 4. Completion of working drawings and specifications

Upon completion of working drawings, specifications, and a quantity schedule sufficient to create a cost estimate and tender paperwork.
45% of total fees payable less payments paid at Steps 1 to 3.

Step 5. Contractor selection for the Architect Contract

Invite, receive, and analyze offers; advise client on contractor selection.
55% of total fees payable, less payments paid at Steps 1 to 4.

Step 6. Functional drawings for on-site work

Submitting functional drawings and information necessary for on-site work.
65% of total fees payable, less payments paid at Steps 1 to 5.

Step 7. Certificate by statutory authorities

Upon submission of the Completion Report and drawings for issuing of a completion/occupancy certificate by statutory authorities, where applicable, and upon the release of as-built drawings.
100% of the fees payable, less payments made at various steps and a retainer.

What are the responsibilities of an Architect?

What are the client's responsibilities?

The Client must fulfill the following requirements in connection with the project and the Architect’s engagement:

➤To supply property lease/ownership documentation.
➤To produce a site plan to a reasonable scale, showing borders, contours at appropriate intervals, existing physical features such as any existing roads, walks, trees, structures, existing service and utility lines, and such lines to which the proposed service can be attached. If such information is not readily available, the Client should arrange for and pay for the survey/collection of essential information.
➤To provide reports on soil conditions and tests as requested by the architect, or to pay for their production.
➤To provide particular conditions/statutory stipulations/codes of practice/rate schedules, etc., that must be obeyed.
➤To pay all statutory sanction fees, taxes, security deposits, and expenses.
➤To follow the Architect's professional advise and make no modifications to the drawings or papers without the Architect's permission.
➤To pay the architect's bills within one month of receipt.
➤Appoint a Construction Manager (Clerk of Works/Site Supervisor or Construction Management Agency if the project is vast and complicated) on the advise of the Architect.
